Terms of service
Effective date: May 24, 2026
These terms of service govern your use of belugahealth.com (the "Website"), operated
by Beluga Management LLC ("Beluga," "we," "us," or "our"). By accessing or using the
Website, you agree to be bound by these terms.
If you do not agree to these terms, please do not use the Website.
These terms apply only to your use of belugahealth.com as a marketing and
informational website. They do not govern any clinical services provided by Beluga
Health, P.A. or its affiliated professional corporations, which are subject to
separate agreements with patients and partners. They do not govern any commercial
partnership agreement between Beluga and a partner brand, which is established through
a separately negotiated and executed master services agreement or similar contract.
What this website is
belugahealth.com is a marketing and informational website. It describes Beluga's
clinical infrastructure services, the protocols our clinical practice uses, the
categories we support, and how brands can engage Beluga as a partner. The website
includes informational content about clinical programs such as AutoRx, descriptions of
our integration paths, and details about our pricing structure.
The Website is not a clinical service. We do not provide medical advice, diagnosis,
treatment, or any patient care through the Website. If you are a patient seeking care,
please consult with a qualified healthcare professional.
The Website is not a contract for services. Information about our pricing, timelines,
and capabilities on the Website is illustrative and informational. Specific commercial
terms with any partner brand are established through separately executed agreements
following a scoping call and contracting process.
Eligibility
You must be at least 16 years of age to use this Website. By using the Website, you
represent that you meet this requirement and that you have the legal capacity to enter
into these terms. If you are using the Website on behalf of a company or organization,
you represent that you have the authority to bind that entity to these terms.
The Website is intended for business-to-business audiences. It is not directed to
consumers seeking clinical care.
Acceptable use
You agree to use the Website only for lawful purposes and only in ways consistent with
these terms. You agree not to:
- Use the Website in any way that violates applicable laws or regulations
- Use the Website to transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to any portion of the Website, our servers, or any related systems
- Use automated means such as scrapers, bots, or crawlers to access the Website at a rate or volume that interferes with normal operation, except for well-behaved search engine crawlers indexing publicly accessible content
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website for commercial purposes without our written consent
- Submit false, misleading, or fraudulent information through our contact or AutoRx forms
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Website in any manner that could damage, disable, overburden, or impair our infrastructure
- Use the Website to harass, abuse, or harm another person
We reserve the right to deny access to the Website to anyone we determine, in our sole
discretion, to be violating these terms.
Forms and inquiries
When you submit information through our contact form or AutoRx brief request form, we
may use that information to follow up with you about Beluga's services, schedule a
scoping call, or provide the materials you requested. Submission of a form does not
create a contract or guarantee a response. We will respond to inquiries we determine
to be relevant to our business in our reasonable discretion.
Information you submit through forms is handled in accordance with our
Privacy Policy.
No medical advice
Nothing on the Website constitutes medical advice. The Website describes our clinical
infrastructure services from a business and operational perspective. Descriptions of
clinical protocols, treatments, or programs on the Website are informational and
intended for business prospects evaluating Beluga as a clinical infrastructure
provider. They are not directed to patients and should not be relied on for any health
decision.
Any actual clinical care is provided by Beluga Health, P.A. or one of its affiliated
professional corporations through licensed physicians, subject to a physician's
independent medical judgment, applicable clinical guidelines, and the laws of each
state where care is delivered. Clinical services are subject to separate
patient-facing agreements, including informed consent and the patient-facing privacy
policy.
If you are a patient experiencing a medical emergency, call your local emergency
services or go to the nearest emergency room.
Forward-looking statements and marketing claims
The Website contains descriptions of our business, our capabilities, our clinical
programs, our integration paths, and our pricing structures. Some statements are
forward-looking, including descriptions of features, timelines, or capabilities that
reflect our current plans and expectations. Forward-looking statements involve risks
and uncertainties. Actual results, timelines, capabilities, or commercial terms may
differ from what is described on the Website.
Specific commercial arrangements with partner brands, including final pricing,
integration timelines, and service-level commitments, are determined through separate
agreements following a scoping call. Nothing on the Website should be interpreted as a
binding commitment to specific terms outside of such an executed agreement.
Customer quotes, social proof, and case study material on the Website are presented in
anonymized or category-only form unless we have specific permission to identify a
partner. Quotes are illustrative and may be edited for length and clarity while
preserving meaning.

The Website and all content on it, including text, graphics, logos, images, custom
illustrations, the four-layer stack diagram, the AutoRx timeline visual, the three
paths orientation visual, the pod staffing visual, software, and design, are owned by

The Website is provided on an "as is" and "as available" basis without warranties of
any kind, either express or implied. To the fullest extent permitted by law, Beluga

reliability, or timeliness of any information on the Website. Information on the
Website may be updated or changed at any time without notice.
Limitation of liability
To the fullest extent permitted by applicable law, in no event will Beluga, its
officers, directors, employees, agents, or affiliates be liable for any indirect,
incidental, special, consequential, exemplary, or punitive damages, including but not
limited to damages for lost profits, lost data, business interruption, or loss of
goodwill, arising out of or related to your use of, or inability to use, the Website,
even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total cumulative liability arising out of
or related to your use of the Website will not exceed one hundred US dollars (USD
$100). This limitation applies whether the claim is based on contract, tort, statute,
or any other legal theory.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so
some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Beluga, its officers, directors,
employees, agents, and affiliates from and against any and all claims, liabilities,
damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out
of or related to your use of the Website, your violation of these terms, your
violation of any law, or your infringement of any third-party rights.
Modifications to the website and terms
We may modify, suspend, or discontinue the Website or any portion of it at any time
without notice. We are not liable for any modification, suspension, or
discontinuation.
We may also update these terms from time to time. When we make material changes, we
will update the effective date at the top and, where appropriate, notify users through
the Website. Your continued use of the Website after an update constitutes acceptance
of the revised terms.
Governing law and dispute resolution
These terms and any dispute arising out of or related to them or to your use of the
Website will be governed by the laws of the State of Delaware, without regard to its
conflict of laws principles.
Any dispute arising out of or related to these terms or to your use of the Website
that cannot be resolved through good-faith discussion will be resolved exclusively in
the state or federal courts located in the State of Delaware. You and Beluga consent
to personal jurisdiction in those courts.
Each party waives any right to a jury trial in any proceeding arising out of or
related to these terms.
Miscellaneous
If any provision of these terms is held invalid or unenforceable, the remaining
provisions will continue in full force and effect. Our failure to enforce any
provision of these terms will not constitute a waiver of that or any other provision.
You may not assign or transfer these terms without our prior written consent. We may
assign these terms in connection with a merger, acquisition, financing, or sale of
assets.
These terms, together with our
Privacy Policy,
constitute the entire agreement between you and Beluga regarding your use of the
Website and supersede any prior agreements or understandings regarding the same
subject matter.
